(Foreclosure Representation to Extend Stay Time)

 

#1.

Attorney reviews the mortgage documents, the assignments and the foreclosure court file to find legitimate affirmative defenses (there are ALWAYS affirmative defenses though some are stronger than others).

 

#2.

Attorney files an appearance, drafts and files the affirmative defenses, and engages in all other court allowed litigation procedures to extend the client’s stay time in the property.

 

#3.

The client uses the extra time to change their circumstances, such as:

 

a)     finding a short sale purchaser so the lawsuit is dismissed;
 
b)    finding a new position so they qualify for a loan modification; 
 
c)    saving money to help the client better get on their feet when the owner, at  the end of the extended stay time process, must legally vacate the property.

In order to best serve its clients, Coffey at Law, Inc. provides FREST on a flat-fee basis. All attorney fees are included in the flat-fees outlined below, regardless of the actual time necessary to prepare the pleadings and defend the case each month.*
